# workers-comp-claim-intake
Document workplace injury claims accurately — from OSHA recordability through state FROI data collection and incident investigation.
## Overview
This skill guides HR managers, safety officers, and workers' compensation coordinators through the structured intake of workplace injury and illness claims. It covers OSHA recordability determination (29 CFR 1904 steps: work-relatedness, new case, general criteria), state-specific First Report of Injury (FROI) data requirements and filing deadlines with urgency flags, and incident investigation documentation using the 5-Why root cause method. Produces two DRAFT documents — a state-structured FROI and an incident investigation report — for authorized HR and safety officer review before submission.
## Use When
- Documenting a workplace injury or illness claim for the first time
- Determining whether an incident is OSHA recordable under 29 CFR 1904
- Collecting state FROI data fields and checking carrier and state filing deadlines
- Drafting an incident investigation report with 5-Why root cause analysis and corrective actions
## Not For
- Making final WC compensability or coverage decisions (carrier and legal determination)
- Filing directly with state workers' compensation boards or carriers

## Workflow Summary
1. **Incident identification** — employer, worksite state, injury date, employer-knowledge date, worker job title, employment type
2. **Incident description** — narrative: task, event/exposure, nature of injury, body part, witness notes
3. **OSHA recordability** — 29 CFR 1904 three-step analysis: work-relatedness → new case → general criteria; output: Recordable / Not Recordable / Indeterminate
4. **Medical treatment and work status** — treatment level, diagnosis, restrictions, ATP referral
5. **State FROI requirements** — state form, required fields, filing deadline computation, URGENT flag if ≤3 days
6. **Incident investigation** — immediate cause, 5-Why root cause chain, contributing factors, corrective action plan with owners and due dates
7. **DRAFT assembly** — FROI and incident investigation report with sensitive-field flags and HR/safety review block
## Output
Two DRAFT documents:
- **DRAFT FROI** — state-structured, with sensitive-field placeholders and filing deadline date
- **DRAFT Incident Investigation Report** — OSHA recordability determination, 5-Why analysis, corrective actions, and review block
